Liability Waiver/Copyright Agreement

By signing this agreement, the client acknowledges and agrees to the following:

1. Safety and Conduct: The photographer and client will prioritize safety during the session. The client agrees to follow the photographer's instructions and take necessary precautions to ensure the safety of all participants. The photographer is not liable for any injuries or damages sustained during the session, or for medical bill compensation.

2. Property Damage: The client assumes responsibility for any damage caused to the photographer’s equipment or property during the session. The photographer is not liable for any damage to the client’s property or personal belongings during the session.

3. Weather and Environment: The photographer is not responsible for any adverse weather conditions or environmental factors that may affect the quality or outcome of the photographs. Rescheduling due to severe weather conditions will be at the photographer’s discretion.

4. Image Quality and Delivery: While the photographer will strive to deliver high-quality images, the client acknowledges that factors such as lighting, environment, and client cooperation may impact the final outcome. The photographer is not liable for any dissatisfaction with the final images.

Copyright and Usage Agreement

By signing this agreement, the client acknowledges and agrees to the following:

1. Copyright Ownership: The photographer retains full copyright ownership of all images produced during the session. The photographer reserves the right to use the images for portfolio, marketing, and promotional purposes, including but not limited to social media, website, and print materials.

2. Client Usage Rights: The client is granted a non-exclusive, non-transferable license to use the final images for personal, non-commercial purposes, including printing, sharing on social media, and displaying in personal spaces. The client agrees not to edit, alter, or sell the images without the photographer’s written consent.

3. Third-Party Usage: The client agrees not to submit the images to contests, publications, or third parties without the photographer’s written consent. If the client wishes to use the images for commercial purposes, a separate agreement and licensing fee will be required.

4. Attribution: When sharing images on social media or other platforms, the client agrees to credit the photographer by including the photographer’s name or business name in the caption or description.

5. Non-Disclosure Fee

   1. Client's Request for Privacy: If the client requests that their images not be shared publicly by the photographer for portfolio, marketing, or promotional purposes, an additional fee of $_100.00_ will be charged. This fee compensates the photographer for the lost opportunity to use the images for business development.

   2. Commercial Use: If the client intends to use the images for commercial purposes, such as marketing, advertising, or any business-related activities, a separate commercial use license must be obtained. The terms and fees for commercial use are as follows:

      • Commercial Use Fee: $_250.00_

      • Permitted Uses: [website, social media, print advertising]

      • Duration of Use: [2 years]

      • Attribution for Commercial Use:  [Client agrees to mention/tag the photographer when sharing or using images obtained during their session.]

Model Release

By signing this agreement, the client grants the photographer permission to use and publish the photographs taken during the session for any lawful purposes, including but not limited to advertising, promotion, and portfolio use. The client waives any right to review or approve the final images or the specific use of the images.
